Service Agreement

This Service Agreement (“Agreement”) governs your use of our website and booking services operated by Best Stay LLC (“Best Stay,” “we,” “us,” “our”). By accessing our website or making a reservation, you agree to this Agreement.

A. Bookings, Payments & Pricing

2) Reservations

  • A reservation is confirmed only after successful payment and confirmation is issued.

  • We may request additional information to verify identity or payment to prevent fraud.

3) Accepted Payment Methods

We accept:

  • PayPal

  • Credit/Debit Cards via Stripe

4) Pricing & Fees

  • Nightly rates, cleaning fees, and other charges (if applicable) are shown at checkout before payment.

  • Pricing may change at any time, but confirmed bookings will not be affected.

  • Sales tax: If applicable, it will be shown clearly at checkout. If your checkout states tax is 0%, then no tax is collected.

5) Payment Authorization

By paying, you authorize us (and our payment processors) to charge the amount shown at checkout. If your bank or PayPal rejects payment, the booking is not confirmed.


B. Cancellations, Changes & Refunds

6) Guest Cancellations

Cancellation eligibility depends on the booking terms shown at checkout and in your confirmation email. In general:

  • If cancellation is allowed, refunds (if any) are returned to the original payment method.

  • Refund timing depends on PayPal/Stripe and your bank.

7) Host Cancellations

We may cancel a booking in rare cases, including but not limited to:

  • Property becomes unavailable due to maintenance/emergency/safety concerns

  • Pricing/listing error

  • Suspected fraud or unauthorized transaction

  • Legal or regulatory restrictions

If we cancel for these reasons, we will issue an appropriate refund based on the booking situation.

8) Date/Guest Changes

Requests to change dates, number of guests, or other booking details must be submitted in writing (email). Changes are subject to availability and may change total pricing.


C. House Rules & Guest Responsibilities

9) Occupancy & Visitors

  • The maximum occupancy is stated in the listing/booking details.

  • Unauthorized additional guests or events may lead to immediate cancellation without refund and additional fees.

10) Property Care

Guests must:

  • Keep the property in reasonable condition

  • Follow posted rules, check-in/out instructions, and noise policies

  • Report damage or issues promptly

11) Prohibited Activities

No:

  • Illegal activity

  • Parties/events unless explicitly approved in writing

  • Smoking in non-smoking areas (if applicable)

  • Tampering with safety devices (smoke alarms, cameras where disclosed, etc.)

Violation may result in cancellation, additional charges, and/or involvement of authorities.


D. Damage, Charges & Security Holds

12) Damage Responsibility

You are responsible for damage caused by you or anyone in your party.

If damage occurs, we may:

  • Request payment for repair/replacement

  • Charge the payment method on file where legally permitted and supported by documented evidence

  • Seek reimbursement through appropriate dispute/claim procedures

13) Extra Cleaning or Rule Violations

Extra fees may apply for:

  • Excessive mess beyond standard cleaning

  • Smoking evidence

  • Unauthorized pets (if pets are not allowed)

  • Unauthorized guests/events

Any fees will be supported with reasonable documentation.


E. Check-In/Check-Out, Availability & Service Limitations

14) Check-In/Check-Out Times

Check-in and check-out times are provided in your booking confirmation. Late checkout may incur fees unless approved in writing.

15) Force Majeure

We are not liable for delays, cancellations, or disruptions caused by events outside our control, including severe weather, natural disasters, utility outages, government restrictions, or other emergencies.


F. Website Use & Intellectual Property

16) Website Acceptable Use

You agree not to:

  • Hack, scrape, overload, or disrupt the site

  • Attempt unauthorized access to systems/accounts

  • Use the site for illegal or abusive activity

17) Content Ownership

All website content (text, branding, design, images, and logos) is owned by Best Stay or licensed to us. You may not copy, reproduce, or redistribute it without permission.


G. Disclaimers & Limitation of Liability

18) No Guarantees

We provide services “as is” and “as available.” We do not guarantee uninterrupted access to the website or that all listings will always be available.

19) Limitation of Liability

To the maximum extent permitted by law, Best Stay is not liable for indirect, incidental, or consequential damages, including lost profits, travel costs, or personal inconvenience.


H. Disputes, Governing Law, and Updates

20) Governing Law

This Agreement is governed by the laws of the State of California, without regard to conflict of law principles.

21) Dispute Resolution

If a dispute arises, you agree to contact us first so we can attempt to resolve it informally. If unresolved, disputes may be handled through appropriate courts in California unless otherwise required by law.

22) Changes to This Agreement

We may update this Agreement from time to time. The latest version will be posted on this page with a new effective date. Continued use of our services means you accept the updated terms.
